Know my rights

What is your current situation?

Did you know that... both H-2A & B workers have the right to receive payment for 75% of the hours on their contract, whether or not they worked it?

Did you know that... H-2A workers do not have a right to get paid for overtime work, or “time and a half?”

Did you know that... your salary with an H-2B visa should be the max rate out of the federal minimum salary, state minimum salary, and your job salary?

Did you know that... any time you spend under the instructions of your boss, whether you're waiting orders or cleaning, is time you should be paid for?

Did you know that... when your work program ends

J-1 visa holders are given a 30-day grace period to prepare to return to their home country?

Did you know that... under federal law, employers cannot retaliate against J-1 employees

for reporting that their workplace rights are being violated?

Did you know that... most J-1 workers who work more than 40 hours a week

(and in some states, more than 8 hours a day), can get paid "time and a half?"

Did you know that... you do not need to pay recruitment fees?

In fact, they're illegal!

Did you know that... when you get to the US, you’re not required to give your boss your personal documents?

That includes your visa and passport!

Did you know that... H-2A and H-2B visa holders are entitled

to reimbursement for the cost of their trip and their visas?
