Job description

***RFI Response***
The company primarily engages in retaining wall construction, including installing mortarless segmental concrete masonry retaining wall units/similar. As specified in the ONET classification for 37-3011, when it is necessary to dig shallow trenches, employees use a tractor (Bobcat skid-steer s650) or a pick and hand shovel, as stated in the job order. These tools are normal and customary to Landscaping and Groundskeeping Workers. The largest expected trench size will be 14 inches deep by 24 inches wide. These trenches are dug, albeit infrequently, in preparation for installing a gravel leveling pad so that the landscape laborers can then install the mortarless segmental concrete masonry retaining walls. This is the first step taken before the retaining walls can be installed, and is not done for any separate purpose. Typically, the employer excludes this digging from its contracted scope of work as it is performed by individuals other than the employer’s workers, meaning any such digging by employees of Miller Wall Company, Inc. is infrequent and sporadic in nature. These minor job duties comport with the O*Net code for Landscape Laborers (37-3011), as well as the job description previously provided by the employer.

Did you know that... H-2A workers do not have a right to get paid for overtime work, or “time and a half?”
